Thank you - we shall look into this further as it is miserable if people spend a small fortune on these dried cherries etc. believing that the product:

"Article 7 of Directive 2002/46/EC - is that the remit of Trading Standards or the MHRA?"
I think it would be Trading Standards. MHRA would be the contact for medicinal products and the ASA would be the contact for misleading claims that are not on the company's own website. A 'food' such as Cherry Active should follow FSA guidelines and (I think) would be policed by Trading Standards.

MHRA, on the other hand, would presumably be the body that decides on potentially medicinal claims and I think the borderline section would decide on food/medicine-type products. Details here: Does My Product Need a Licence?

Not that I'm piling on the misery but you may remember how lamentable the FFTB Child Survey 2007 was. Nonetheless, undaunted, because who checks this stuff (apart from us) FFTB is shilling that it is worth becoming one of their corporate sponsors because their surveys are strong media hooks plus, they have lobbying power:

Lobbying - FFB is a NGO and registered charity and is in a good position to help influence Government thinking on health and nutrition. Each year we present at key conferences and build relationships with key organisations and government departments to help bring ‘Food for the Brain’ up the agenda.
